2. Scope
These general terms apply to every offer, sale, purchase, export service and related administrative service provided by F.S. Auto BV, unless a written agreement signed by both parties states otherwise. Placing an order or signing a sales agreement implies acceptance of these terms.
3. Offers and prices
Offers and valuations are valid for 7 calendar days and remain subject to a physical inspection of the vehicle. Prices shown on this website are in euro and include Belgian VAT unless the vehicle is explicitly marked as sold under the margin scheme or as an intra-community/export delivery. Registration costs, transport and optional preparation are invoiced separately.
4. Vehicle information
Technical data, mileage, equipment and photographs are provided in good faith and may contain errors or refer to a similar vehicle. They do not constitute a contractual guarantee. The buyer is invited to inspect the vehicle and its documents before purchase.
5. Payment and transfer of ownership
Unless otherwise agreed, the full price is payable before the vehicle is handed over. Cash payments are accepted only within the limits set by Belgian anti-money-laundering legislation. The vehicle remains the property of F.S. Auto BV until full payment has been received. Risk passes to the buyer at handover or at loading for transport.
6. Warranty
Consumers buying a second-hand vehicle receive the legal warranty of twelve months under Belgian law, starting on the date of delivery. The warranty does not cover normal wear, consumables, damage caused by misuse, neglected maintenance, competition use or modifications. Sales to professional buyers and export sales are made as is, without warranty, as stated on the invoice.
7. Purchase of your vehicle
The seller guarantees being the lawful owner of the vehicle, that it is free of any pledge, lease or outstanding finance, and that the declared mileage and history are accurate. Incorrect declarations allow F.S. Auto BV to cancel the agreement or adjust the price.
8. Export and administration
When we arrange export, the buyer supplies the documents required in the country of destination and remains responsible for local registration, taxes and homologation. We provide the COC document, invoice and, where applicable, transit plates and transport.
9. Cancellation
A vehicle order may be cancelled by the buyer against payment of a fixed compensation of 15% of the sale price, without prejudice to our right to claim higher proven damages. There is no right of withdrawal for vehicles sold on our premises, as this is not a distance contract.
10. Liability
Our liability is limited to the invoiced value of the vehicle or service concerned. We are never liable for indirect damage such as loss of use, rental costs or loss of profit.
11. Complaints and applicable law
Complaints must be sent in writing to info@fs-auto.be within 8 days of delivery. These terms are governed by Belgian law. Disputes fall under the exclusive jurisdiction of the courts of Brussels. Consumers may also use the European ODR platform.
